Terms of Service

These Terms of Service ("Terms") govern your use of PostHub (the "Service"), operated by Nguyễn Viết Dân ("we", "us", "our"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

PostHub allows you to connect social media accounts you own or are authorized to manage and to create, schedule and publish content (text, images, videos and comments on your own posts) to those accounts and view the performance of your posts, through the platforms' official APIs. We act solely as a tool operating on your instructions; we do not create, review or endorse the content you publish.

2. Eligibility and accounts

• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
• You must provide accurate registration information and keep your password confidential. You are responsible for all activity under your account.
• You may only connect social media accounts that you own or have explicit permission to manage.

3. Connected platforms

• When you connect a platform (TikTok, Facebook, Instagram, Threads, YouTube, LinkedIn, X, Pinterest, Telegram, Bluesky, Discord, Tumblr, Mastodon, Google Business Profile or others), you authorize us to access and use that account on your behalf, limited to the permissions you grant and the features of the Service.
• You must comply with each platform's terms, community guidelines and developer policies, including the TikTok Terms of Service, Meta Terms, YouTube Terms of Service, LinkedIn User Agreement and X Terms of Service, as well as the terms of Threads, Pinterest, Telegram, Bluesky, Discord, Tumblr, Mastodon servers and Google Business Profile.
• Platforms may change or restrict their APIs at any time. We are not responsible for features that stop working because of platform changes, rate limits, account restrictions or content moderation decisions made by a platform.
• You can disconnect a platform at any time from the Service or from the platform's own settings.

4. Your content

• You retain all rights to the content you upload. You grant us a limited, non-exclusive, worldwide licence to host, store, process and transmit your content solely to provide the Service (for example, to publish it to the platforms you select).
• You represent that you own or have the necessary rights to all content you upload, including music, images and footage, and that publishing it does not violate any law or third-party rights.
• You are solely responsible for your content and for the consequences of publishing it.

5. Acceptable use

You agree not to use the Service to:

• Publish content that is illegal, infringing, defamatory, hateful, harassing, sexually explicit involving minors, or that violates any platform's community guidelines.
• Send spam, engage in engagement manipulation, artificially inflate metrics or run coordinated inauthentic behaviour.
• Access accounts you are not authorized to manage, or circumvent platform security or rate limits.
• Reverse engineer, scrape or interfere with the Service, or resell it without our written permission.
• Upload malware or attempt to gain unauthorized access to our systems or other users' data.

We may suspend or terminate accounts that violate these rules, and may remove content at the request of a platform or as required by law.

6. Plans, payment and cancellation

• Some features require a paid subscription. Prices and plan limits are shown in the Service at the time of purchase.
• Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current period.
• Fees are non-refundable except where required by law or stated otherwise at purchase.
• We may change prices with at least 30 days' notice; continued use after the change takes effect constitutes acceptance.

7. Intellectual property

The Service, including its software, design, logos and documentation, is owned by Nguyễn Viết Dân and protected by intellectual property laws. Except for the rights expressly granted in these Terms, no licence is granted to you. Platform names and logos (TikTok, Facebook, Instagram, Threads, YouTube, LinkedIn, X, Pinterest, Telegram, Bluesky, Discord, Tumblr, Mastodon, Google) are trademarks of their respective owners; PostHub is not affiliated with, endorsed by or sponsored by any of them.

8. Termination

You may stop using the Service and delete your account at any time (see our Data Deletion page). We may suspend or terminate your access if you breach these Terms, if required by law or a platform, or if we discontinue the Service, in which case we will give reasonable notice where possible. Upon termination, your right to use the Service ends and we will delete your data in accordance with our Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that posts will be published at the exact scheduled time, that platforms will accept your content, or that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Nguyễn Viết Dân shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD 100 if you have not paid us anything.

11. Indemnification

You agree to indemnify and hold harmless Nguyễn Viết Dân and any agents or contractors acting on our behalf from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your content, your use of the Service or your violation of these Terms or any platform policy.

12. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes we will notify you by email or in the Service at least 14 days before they take effect. Continued use after that date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of Vietnam, unless mandatory consumer protection law in your country provides otherwise.
